Terms & Conditions
The terms and conditions under which you may loan products from Kia Australia are set out below. Please read these Terms & Conditions carefully before placing an order with eQuipt Pty Ltd.
By completing the customer application process and/or placing an order via kialoantools.online, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions.
1. The Agreement
1.1 The entire agreement between the customer (“you”) and eQuipt Pty Ltd (“eQuipt”) for the loan of goods consists of:
(a) these Terms & Conditions; and
(b) the terms of each accepted order.
1.2 A binding agreement is formed once eQuipt receives and accepts an order. eQuipt is under no obligation to loan, sell, or supply goods until an order is accepted.
1.3 Each order constitutes a separate and independent agreement and may be accepted or rejected by eQuipt at its discretion.
2. Loan, Delivery and use of Goods
2.1 Orders are placed by selecting goods, entering the required details, and submitting the order via the website or booking platform.
2.2 Any person at the delivery address who accepts delivery of the goods is deemed authorised to do so on your behalf.
2.3 If delivery cannot be completed, you must liaise directly with the carrier to arrange redelivery. Additional delivery or handling fees may apply.
2.4 Deliveries occur Monday to Friday between 9:00am and 6:00pm (excluding public holidays). Exact delivery times are not guaranteed.
2.5 You must use the goods only for their intended purpose, in accordance with manufacturer instructions and all laws, and only by competent, trained personnel. You must not modify, tamper with or repair the goods without eQuipt’s prior written consent.
2.6 You must not sell, dispose of, sub-hire, lend, part with possession of, relocate (except to return the goods to eQuipt), or create or allow any lien, charge, encumbrance or security interest over the goods
3. Risk and Title
3.1 Risk of loss or damage to the goods passes to you upon delivery to the nominated delivery address and remains until return to eQuipt. You must keep the goods safe, secure, clean and in good repair (fair wear and tear excepted), store them securely when not in use and prevent theft, loss, seizure or misuse.
3.2 Title in loaned goods does not pass to you. You receive the goods on hire only and acknowledge you hold the goods as sub‑bailee for the supplier of those goods to eQuipt and must not assert any ownership or other right in the goods.
3.3 You must notify eQuipt of any issues with delivered goods on the same business day as receipt.
4. Price of Goods and Payment
4.1 The price payable includes:
(a) the price specified on the website or booking platform at the time the order is confirmed; and
(b) any additional fees expressly provided for under these Terms & Conditions, including (without limitation) fees arising from late return, loss, damage, misuse, administrative rework, cleaning, re-issue of documentation, replacement logistics, or failure to comply with return requirements.
4.2 By placing an order, you acknowledge and agree that such additional fees may apply where the relevant triggering circumstances occur.
4.3 Pricing and fee disclosures must be provided via the website, booking platform, reservation notes, program documentation, OEM communications, or other written materials forming part of the order process.
4.4 Prices are subject to change for future orders. Changes do not affect orders already accepted.
4.5 Payment is due at the time of placing an order. Accepted payment methods include credit card, Stripe, and bank transfer.
4.6 You authorise eQuipt to charge any credit card you provide and/or apply any security bond held to recover any amounts payable by you under these Terms and Conditions, including hire charges, late fees, amounts for loss of or damage to the goods, and any administrative or recovery costs. This right is in addition to any other rights or remedies available to eQuipt. You must ensure your payment details remain current and sufficient to meet your obligations.
5. Packaging and Labelling of Goods
5.1 Goods will be supplied in packaging appropriate to protect the equipment during transit.
5.2 Returns must be made using the return shipping method and documentation provided unless otherwise approved in writing by eQuipt.
6. Licence
6.1 You are granted a limited licence to use the eQuipt website solely for the purpose of placing and managing orders.
6.2 No other use of the website is permitted.
7. Intellectual Property Rights
7.1 All intellectual property displayed on the website remains the property of eQuipt or its licensors.
7.2 You must not copy, reproduce, or misuse any intellectual property without prior written consent.
8. Liability
8.1 To the extent permitted by law, eQuipt’s liability for goods or services supplied is limited to:
(a) replacement of the goods or supply of equivalent goods; or
(b) resupply of services or payment of the cost of resupply.
8.2 eQuipt is not liable for indirect or consequential loss, including loss of profits or business interruption, except where required by law.
8.3 Nothing in this Agreement excludes, restricts or modifies any non-excludable rights under the Australian Consumer Law. Subject to that, the goods are provided “as is” and Equipt gives no warranties other than those expressly stated.
9. Security
9.1 You are responsible for maintaining the confidentiality of your account credentials.
9.2 You are liable for all activity conducted under your account.
10. Damage, Loss, Late Return, and Administrative Fees
10.1 During the loan period, you are responsible for any loss of, or damage to, the equipment, regardless of cause.
10.2 You must notify eQuipt as soon as practicable (and within 24 hours) of any theft, loss, damage, malfunction, accident, seizure or claim affecting the goods and must provide all information reasonably requested.
10.3 Where equipment is lost or damaged:
(a) eQuipt may elect to repair or replace the equipment on reasonable commercial and safety grounds;
(b) you agree to indemnify eQuipt for replacement costs, including replacement on a new-for-old basis where commercially reasonable; and
(c) you agree to indemnify eQuipt for any lost hire opportunity while the equipment is unavailable.
10.4 eQuipt (and/or the supplier of those goods) may on reasonable notice inspect the goods. If you fail to pay any amount when due or fail to return the goods on time, eQuipt (or our nominee) may enter your premises to recover the goods.
10.5 You acknowledge the goods may be subject to a security interest and/or registration on the PPSR in favour of eQuipt (and/or the supplier of those goods). You must not register (or allow to be registered) any financing statement or other interest in respect of the goods.
11 Late Return and Administrative Fees
11.1 Where equipment is returned late, returned without required documentation or packaging, returned using an unauthorised shipping method, or subject to repeated misuse or administrative rework, eQuipt may charge reasonable administrative, handling, logistics, and recovery fees.
11.2 These fees form part of the agreed consideration under each order, are intended to protect equipment availability, program integrity, and network fairness, and are not penalties.
12. Notification of Changes
12.1 eQuipt may update these Terms & Conditions from time to time by publishing updated terms on its website.
12.2 Updated terms apply only to orders placed after the update date, unless otherwise required by law.
